Intoxication Offenses

Driving While Intoxicated is the intoxication offense most people are familiar with but there are many other offenses that can result from the use of alcohol or drugs.  The consequences of a second or third DWI are different than a DWI first. Here are some of the other offenses related to intoxication.  Lauren can represent you in any of these matters effectively and aggressively.

DWI 1st – Class B misdemeanor

DWI 2nd – Class A misdemeanor. There must be one prior misdemeanor conviction of Driving While Intoxicated.

DWI 3rd or more – A misdemeanor DWI may be enhanced to a felony as a result of 2 prior misdemeanor DWI convictions or an intoxication manslaughter conviction.  The State can uses convictions from other states if it is a substantially similar offense.

Driving While Intoxicated with Child Passenger
– a child for this offense is defined as person younger than 15 years of age.  This is a state jail felony.

Intoxication Assault – if by accident or mistake, while operating a motor vehicle in a public place while intoxicated, by reason of that intoxication causes serious bodily injury to another.  This is a 3rd degree felony. If serious bodily injury is to a peace officer, firefighter or EMS personal while that person is in actual discharge of an official duty, it is a 2nd degree felony.

Intoxication Manslaughter – if a person operates a motor vehicle, aircraft, watercraft, or an amusement ride and is intoxicated and by reason of that intoxication cases the death of another by accident or mistake. This is a 2nd degree felony. If a peace officer, firefighter or EMS personal is killed while that person is in actual discharge of an official duty then it is a 1st degree felony.
