There is no such thing as a typical DWI case. Lauren will personally handle all of your needs through the duration of your case. Often, a DWI arrest will occur after a police officer has stopped a driver for a traffic violation. While speaking with a driver, the officer may notice the smell of alcohol. The officer will then being asking the driver a series of questions and if the officer believes that the driver is having difficulty answering the questions, the driver will be asked to step out the car.
This is the beginning of the DWI investigation. The officer is looking for probable cause to make an arrest for DWI. Once out of the car, the officer will being conducting the Standardized Field Sobriety Tests (SFSTs). Standardized Field Sobriety Tests are regulated by the National Highway Traffic Safety Administration and Lauren knows when the officers are not administering the field sobriety tests properly. There are three standardized tests the officer will administer. The Horizontal Gaze Nystagmus (HGN), the Walk and Turn, and the One Leg Stand. For the HGN, a person is asked to follow the tip of an object, usually a pen, with their eyes only. The officer is looking for Nystagmus, the involuntary jerking of the eye. The Walk and Turn and the One Leg Stand are divided attention tasks that demonstrates a persons ability to do two things at once. The reason officers’ believe that these test can demonstrate if a person is too intoxicated to drive is that driving is a divided attention task.
Many times people believe they passed the SFSTs. However, there is no pass or fail when it comes to field sobriety tests. The officer is looking for clues in your eyes and your performance on the Walk and Turn and One Leg Stand to determine intoxication.
The officer may ask you to blow in a Portable Breath Test (PBT), recite your alphabet, or count on your fingers. These are not part of SFSTs but the officer is including them in his investigation.
